IN THE MATTER OF ESTABLISHING GROSS WEIGHT LIMITS FOR ALL COUNTY ROAD AND BRIDGES IN TALLAHATCHIE COUNTY, MISSISSIPPI
This day there came on before the Board of Supervisors of Tallahatchie County, Mississippi, the matter of the need to establish gross weight and load limits for all county roads and bridges. Following discussion, upon motion made by Supervisor Cole and seconded by Supervisor Havens, it was resolved as follows, to wit:
RESOLUTION ESTABLISHING GROSS WEIGHT AND LOAD LIMITS
FOR ALL ROADS AND BRIDGES IN TALLAHATCHIE COUNTY, MISSISSIPPI
WHEREAS, the Board of Supervisors of Tallahatchie County, Mississippi, does hereby find and determine that current practices involving excessive weight limits being hauled upon road and bridges in Tallahatchie County by non-resident haulers have created a hazard to the traveling public and the public health, safety and welfare of the citizens of Tallahatchie, County, Mississippi, is being threatened by damage to public roads and bridges caused by excessive weight limits; and,
WHEREAS, the Board of Supervisors is authorized by the provisions of the Mississippi Codes, to regulate maximum load limits of any vehicles using county roads and bridges and to require permits and bonds to assure against undue damage to road foundations, surfaces or structures.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Tallahatchie County, Mississippi, as follows:
1. For all roads, except bridges with lower weights posted and designated State Aid roads, the maximum load of any vehicle owned or used by a non-resident, individual, person, firm, corporation, or entity of Tallahatchie County using county roads shall not exceed 30,000 pounds. Where bridges are posted with a lesser weight than 30,000 pounds, the posted weight shall be observed.
2. Any vehicle covered by Section 1 hereof using designated State Aid roads with weight signs posted at 57,650 shall not exceed 57,650 pounds.
3. Special permits may be granted in the discretion of Tallahatchie County authorizing the operation of vehicles exceeding the maximum weight specified above. Any applicant desiring a special permit shall file an application in writing with the Office of the Chancery Clerk, Tallahatchie County Courthouse, Charleston, Mississippi, seven (7) days prior to commencement of operation. Said application shall specifically describe the general operation and load to be moved, the particular road for which the permit to operate is requested and whether such permit is requested for a single trip or continuous operation. Such permit, if granted, may limit the number of trips, establish route to be traveled and maximum speed limit, establish seasonal or time limitations within which vehicles described may be operated or otherwise prescribe undue damage to road foundations, surfaces or structure. Tallahatchie County may require a minimum surety bond of $50,000.00 or other security as it deems necessary to compensate for any injury to roadway, road structures or bridge, which bond may be increased by Tallahatchie County during the operation of such vehicles and may further require each truck to present scale tickets. Any permit granted pursuant to this section shall be carried in each vehicle operating under such permit at all times and may be revoked by Tallahatchie County for cause.
4. Wherein mentioned in this Order, gross weight shall be defined as the weight of the load and vehicle combined.
5. Violation of any provisions of this ordinance will be punishable as a misdemeanor and shall render such violator liable civilly for any damages done to such roads or bridges.
6. This Ordinance shall be published in The Sun Sentinel for three (3) consecutive weeks and shall take effect immediately, and supersedes any prior Order of the Board of Supervisors regulation weights of vehicles and loads. This Ordinance Shall further be posted at the Tallahatchie County Courthouses in Charleston and Sumner and shall be distributed to the Tallahatchie County Sheriff's Department.

Seal bids will be received by the East Tallahatchie School District, 411 Chestnust, Charleston, Ms 38921 up to and no later than 5:00 p.m. on May 9, 2024, and opened up at the School board meeting thereafter. The bids will be for the right to THIN TIMBER designated for that purpose on approximately 89 acre of School Trust Lands in Section 16 Township 23 north, Range 03 east, Tallahatchie County, MS.
