FINAL NOTICE AND PUBLIC EXPLANATION OF A PROPOSED ACTIVITY IN A FEDERAL FLOOD RISK MANAGEMENT STANDARD (FFRMS) DESIGNATED FLOODPLAIN
To: All interested Agencies, Groups, and Individuals
This is to give notice that the City of Charleston, the Responsible Entity under 24 CFR Part 58, has conducted an evaluation as required by Executive Order 11988 (Floodplain Management), as amended by Executive Order 13690, and Executive Order 11990 (Protection of Wetlands), in accordance with HUD regulations at 24 CFR 55.20 (Subpart C-Procedures for Making Determinations on Floodplain Management and Protection of Wetlands).
The activity is being considered for funding under the Community Development Block Grant (CDBG) Program for Program Year 2025. The proposed project is located within the City of Charleston, Tallahatchie County, Mississippi, and lies within the Federal Flood Risk Management Standard (FFRMS) floodplain.
The extent of the FFRMS floodplain was determined using the 0.2% Annual Chance Flood approach, in accordance with HUD guidance.
The proposed activities involve rehabilitation and replacement of existing sewer lines, associated service connections, and related appurtenances. The project will occur within previously disturbed municipal rights-of-way. The project area is located within a riverine floodplain associated with the Tallahatchie River basin, which provides natural and beneficial functions including floodwater conveyance, groundwater recharge, erosion control, water quality support, and habitat for local flora and fauna.
The City of Charleston has considered the following alternatives and mitigation measures to minimize adverse impacts and restore and preserve natural floodplain functions:
1. Alternative Locations - Relocating the project outside the floodplain was not practicable because the existing utility systems, service ·connections, and rights-of-way are already located within or adjacent to the mapped floodplain, and service to existing customers cannot be provided from outside the area.
2. No-Action Alternative-This alternative was rejected because failing to address failing or undersized utility infrastructure would pose health and safety risks, limit economic resilience, and jeopardize compliance with state and federal standards.
3. Alternative Construction Methods - Adjusting project alignment was examined; however, existing easements, roadway corridors, and utility tie-ins require work to occur within the existing floodplain footprint.
4. Mitigation Measures - The City will implement the following measures:
• All work will occur in previously disturbed ROW to limit new impacts.
• Construction will follow state and local floodplain management requirements, including coordination with the Tallahatchie County Floodplain Administrator.
• Erosion and sedimentation control measures will be implemented and maintained.
• Ground disturbance will be minimized to the greatest extent feasible.
• Improvements will be constructed in a manner that maintains or improves system resilience and reliability.
There are no LOMA or LOMR determinations applicable to this project at this time. The City of Charleston acknowledges and will comply with all state and local floodplain development requirements.
The City of Charleston has reevaluated the alternatives to carrying out the project in the floodplain and has determined that there is no practicable alternatives to completing the needed infrastructure work within the identified floodplain. Environmental review records documenting compliance with Executive Order 11988 (as amended), Executive Order 13690, and Executive Order 11990 are available for public inspection, review, and copying during normal business hours at the location listed in the final paragraph of this notice.
There are three primary purposes for this notice:
1. People who may be affected by activities in a floodplain and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas.
2. An adequate public notice program can be an important public educational tool. The dissemination of information and request for public comments about floodplains can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas.
3. A matter of fairness, when the Federal government determines it will participate in actions taking place in a floodplain, it must inform those who may be put at greater or continued risk.
