NOTICE OF PROPOSED RESORT AREA
Pursuant to Miss. Code Ann. 67-1-72, notice is hereby given that application is being made for the following described area to be recognized as a “Qualified resort area.”
Legal Description: Garden of Enid, LLC - Lots 6-14
Being Lot 6 thru Lot 14 in the Village of Enid located in the Southwest 1/4 of Section 13, Township 26 North, Range 3 East in the First Judicial District of Tallahatchie County, Mississippi, and being more particularly described as follows:
Commencing at a found brass disk at the Southeast corner of the Southwest quarter of said Section 13, thence North 68 degrees 43 minutes 17 seconds West a distance of 1,500.77 feet to a found 1/2” bolt at the Northeast corner of Lot 12 (N: 1,679,955.309, E: 2,415,821.900), said point being the point of beginning; thence South 31 degrees 10 minutes 51 seconds East, along the East line of Lots 12, 11 and 10, a distance of 69.89 feet to a found 8” spike in Jackson Avenue; thence South 31 degrees 50 minutes 09 seconds East, along the East line of Lots 9, 8, 7 and 6, a distance of 94.80 feet to a set 1/2” rebar at the Southeast corner of said Lot 6; thence South 58 degrees 16 minutes 42 seconds West, along the South line of said Lot 6, a distance of 100.00 feet to a set 1/2” rebar at the Southwest corner of said Lot 6; thence North 31 degrees 43 minutes 47 seconds West, along the West line of Lots 6, 7, 8 and 9, a distance of 95.03 feet to a found 8” spike in Jackson Avenue; thence North 31 degrees 48 minutes 38 seconds West, along the West line of Lots 10, 11 and 12, a distance of 70.19 feet to a found iron pin with David Evans #2607 cap; thence North 30 degrees 58 minutes 44 seconds West, along the West line of Lot 13, a distance of 22.84 feet to a found 3/8” iron pin at the Southwest corner of Lot 14; thence North 30 degrees 50 minutes 16 seconds West, along the West line of said Lot 14, a distance of 23.42 feet to a found 3/8” iron pin at the northwest corner of said Lot 14; thence North 58 degrees 29 minutes 00 seconds East, along the North line of said Lot 14, a distance of 99.62 feet to a found 3/8” iron pin; thence South 31 degrees 38 minutes 42 seconds East, along the East line of said Lot 14, a distance of 23.31 feet to a found 3/8” iron pin at the Northeast corner of Lot 13; thence South 32 degrees 35 minutes 21 seconds East, along the East line of said Lot 13, a distance of 23.13 feet to the point of beginning and containing 0.485 total acres more or less and according to a survey prepared by Everette D. West, MS PLS. No. 3234 dated January 30, 2023.
All bearings are grid bearings.
Said property is subject to all right of way, easements and restrictions of record.
This application is being filed by the Members of the Tallahatchie County Board of Supervisors. The specific area under consideration as hereinabove described as shown in the map attached as follows:
That the reasons why the area should be declared a resort area are as follows:
1. That the property is of great cultural and historical significance.
2. That a restaurant, The Enid Depot, on the property has been declared to have “...the best steak in the State of Mississippi...” by the Mississippi Beef Council, which appeared in an article in the publication of “Only in Your State” Magazine.
3. That the property abuts the historic boyhood home of the Late Colonel John W. Mitchell and the historic marker honoring him as well. Colonel John W. Mitchell was responsible for planning the mission which resulted in the bringing down of the airplane carrying the Japanese planner of the Pearl Harbor attack upon the United States of America on December 7, 1941. This helped to avenge, in part, “...the day that will live in infamy...”.
4. That significant improvements have been made to the property included but not limited to, renovations and improvements of the building used as a restaurant located thereon, parking improvements, improvements to utilities, and to the general usage of the area and the potential usage of the area sought to be designated as a resort area. The improvements completed and to be completed would be in the best interest of not only Tallahatchie County, but the State of Mississippi as a whole.
5. That, The Enid Depot property has gained special recognition by the Mississippi Department of Archives and History as a historic property of significant interest and note for the history of our state and nation.
That approval of the described area will permit the sale of alcoholic beverages in the proposed resort area. Expressions of opinions are requested of residents in the area. Any person wishing to request a hearing before the Board of Tax Appeals on the resort status of the area described herein must request a hearing in writing and it must be received within (15) fifteen days from the first day the notice was published. Requests shall be sent to Chief Counsel, Legal Division, Department of Revenue, P.O. Box 22828, Jackson, Mississippi 39225.
