FINAL NOTICE AND PUBIC EXPLANATION OF A PROPOSED ACTIVITY IN A FEDERAL FLOOD RISK MANAGEMENT STANDARD DESIGNATED FLOODPLAIN
To: All interested Federal, State, and Local Agencies, Groups, and Individuals
This is to give notice that the Town of Sumner, acting as the Responsible Entity under 24 CFR Part 58, has conducted an evaluation as required by Executive Orders 11988 (as amended by Executive Order 13690) and 11990, in accordance with HUD regulations at 24 CFR 55.20, Subpart C – Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under the Community Development Block Grant (CDBG) Program 1141-24-353-PF-01. The proposed project is located throughout the Town of Sumner, in Tallahatchie County, Mississippi, and is situated within the Federal Flood Risk Management Standard (FFRMS) floodplain. The extent of the FFRMS floodplain was determined using the 0.2 percent flood approach.
The proposed activity involves the rehabilitation of sewer pump stations and sewer mains throughout the project area. The existing infrastructure is aging and deteriorating, requiring frequent repairs, manual controls, and temporary bypass pumping. Stormwater infiltration and years of service have led to persistent issues such as odors, slow drainage, and blocked sewer lines. Cracked and deteriorating sewer mains have further exacerbated these problems, prompting regular complaints from residents and businesses. These conditions are documented through photographs, inspection reports, and repair records. The project area lies within a floodplain that provides natural and beneficial functions such as floodwater storage and conveyance, groundwater recharge, erosion control, and habitat for local flora and fauna.
The Town of Sumner has considered the following alternatives and mitigation measures to minimize adverse impacts and to restore and preserve natural and beneficial functions and intrinsic values of the existing floodplain: (I) Reasons for floodplain location: The sewer infrastructure is already located within the floodplain, and rehabilitation must occur in place to address public health and safety concerns. (II) Alternatives considered: Relocation of infrastructure was deemed impracticable due to cost, technical feasibility, and disruption to service. (III) Mitigation measures: The project will incorporate flood-resistant materials and design standards to minimize future flood risk. Compliance with state and local floodplain protection procedures will be maintained throughout. No final or conditional LOMRs or LOMAs from FEMA apply to this project currently. The Town of Sumner has reevaluated alternatives to building in the floodplain and determined that there is no practicable alternative to proceeding with the proposed rehabilitation. Environmental files documenting compliance with Executive Orders 11988 and 11990 are available for public inspection, review, and copying upon request.
There are three primary purposes for this notice. First, people who may be affected by activities in a floodplain and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comments about a floodplain can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in a floodplain, it must inform those who may be put at greater or continued risk.
