SUMNER — Circuit Judge Smith Murphey on Friday declared a mistrial in the case of a Tutwiler man charged with second-degree murder.
Second Judicial District circuit court proceedings in the case of David Holman, 26, got underway Wednesday, Nov. 13, with the start of jury selection at the Tallahatchie County Courthouse. A jury was impaneled, but Murphey announced the mistrial two days later.
“It came to light that several of the jurors had relationships with both sides that would prevent the case from being tried fairly,” Assistant District Attorney Steven Jubera said after being contacted Tuesday. He declined to elaborate.
Jubera said the state plans to retry the case “as soon as possible.” No date has been set.
Holman is one of five men indicted in connection with the October 2016 nighttime shooting death of Moseah L. McDanail, 22, of Tutwiler, during an incident in Webb.
